By using our services either via the chat, webcam, call, email, and Skype you are deemed to consent to the terms and conditions of the following disclaimer, and any information and advice given by your emobileclinic doctor. If you do not agree to these terms and conditions please do not become a member and make use of our services. emobileclinic reserves the right to change these terms and conditions at any time by posting changes online. You are responsible for regularly reviewing information that we post online to get notice of such changes and amendments.
Any continued use of our site and services will constitute acceptance of these changes. Membership fee is free at the moment.
Emobileclinic provides medical advice, referrals, appoiontment and arrangement of physical investigations, consultation through online chat, by phone, email and by Skype in Nigeria and the rest of Africa countries. Memberships are for adults, aged 18 years and above only. Emobileclinic will not consult with or offer advice for minors under the age of 18 years. Any additional costs for investigations, prescription charges or fees from other doctors after referral are deemed payable by the emobileclinic member.
Emobileclinic reserves the right to refuse a person membership if their medical background is deemed unsuitable for online consultations.
Advice & Diagnosis
Due to the nature of communication :through chat, the phone and e-mail, advice and diagnosis is given without the benefit of physical examination. We rely on the information you give your doctor at that time, and also the information you give when you fill in the health questionnaire.
emobileclinic is not responsible if you withhold information and you must provide the necessary and relevant information when asked by your doctor, if you do not, emobileclinic is not liable for any consequences of the advice or diagnosis given.
Your doctor may ask for a Skype consultation to help form a diagnosis or for some investigations to be performed to aid diagnosis. A time for the Skype consultation will be mutually agreed. Failure to be present on Skype without prior notice will mean that the full fee of on line consultation will not be refunded . Emobileclinic consultation fee are as follows; $100 for consultation with site A list doctors. $80 for consultation with B list site doctors and $50 for consultation with C list doctors. Should investigations be required, the emobileclinic doctor will refer you appropriately. If you are remote from your emobileclinic doctor we will give you advice on how to access local medical provision but will not be responsible for arranging an appointment with another non emobileclinic doctor, nor are we responsible for the actions of that doctor or other 3rd party healthcare worker. If you have an emergency medical problem then you must access your local emergency medical services, and emobileclinic is not responsible should you not do this. No promises are made or given or intended by the advice given by emobileclinic and no information, advice or diagnosis made by emobileclinic shall be deemed the only or best possible at that time with respect to the matter in question.
Prescriptions
Prescriptions issued by emobileclinic doctor are considered to be private and not NHS. Emobileclinic has no jurisdiction as to the cost of the medication which may vary from pharmacy to pharmacy, and emobileclinic is not responsible should the medication be taken inappropriately. emobileclinic is not responsible if the member takes undisclosed medication from another source or has a medical condition that has not been disclosed on the health questionnaire or through communication with site doctors and there follows an adverse reaction to the emobileclinic doctor’s prescribed medication.
Emobileclinic doctors will not prescribe certain medication i.e. morphine, diamorphine, methadone, amphetamines, and reserves discretion in prescribing other medications.
Emobileclinic and its doctors reserve the right to refuse to generate prescriptions if we deem that it is not in the best interest of the patient. A further item charge will be made if the prescription has to be reissued due to loss or theft, and emobileclinic reserves the right to not reissue a prescription if emobileclinic doctors feel that “loss or theft” is a means of obtaining further supplies of the medication before the next due date.
If a member refuses to pay after arrangement of a prescription then his membership will foreclose. If a member has joined for the sole purpose of obtaining Class 1 or 2 drugs then membership will be revoked with hope of no return .
Investigations
These can be arranged for members if details of local private hospitals are given to emobileclinic , however the costs of the investigations will fall on the member and emobileclinic is not liable for any accident, loss, or injury suffered during the course of obtaining the investigation.
Membership
Membership will be terminated if member behaves in such a way that is deemed rude or aggressive to other emobileclinic members, the member behaves in such a way that is deemed rude or aggressive to doctors or staff, non-payment of agreed fees any attempted abuse of the system or allowing others to use the system in the members name. Once a member you agree not to use emobileclinic :
(i) in a manner that is prohibited by any law or regulation, or to facilitate the violation of any law or regulation;
(ii) to invade the privacy of third parties;
(iii) to impersonate emobileclinic personnel or other parties or entities;
(iv) to transmit unlawful, fraudulent, offensive, obscene, pornographic, defammatory, abusive, threatening, or otherwise objectionable material, or;
(v) to encourage conduct that would give rise to civil or criminal liability; not to violate, or assist in violating, the security of emobileclinic, whether intentionally, negligently or otherwise; not to attempt to utilise another user’s account, username, password, PIN and not to transmit by means of emobileclinic’s any data or material that contains software viruses or any other malicious code designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
PIN & Password
When you have been accepted as a member, you will be issued an identification code or PIN and a password that will be required to access emobileclinic services. After the initial issuance by emobileclinic , you may change your individual password and inform us immediately. You may access emobileclinic services only using your PIN and password, and may not allow any other person to access emobileclinic using your PIN and password. You agree: not to disclose your Password to any other person or entity;
(ii) to make all reasonable efforts to keep your password secret and confidential, and;
(iii) to promptly notify emobileclinic any actual or suspected breach of security of emobileclinic such as loss, theft or unauthorised disclosure of your PIN or Password.
You are solely responsible for maintaining the confidentiality of your password, and personally responsible for all use, whether authorised or unauthorised, of emobileclinic under your password. Remember your username and password. If you forget either of them, e-med may disclose them to you under security procedures determined by e-med, which may result in delays in your ability to access emobileclinic services.
Linked Sites
Emobileclinic has no control over the content of world wide web sites that may be linked to emobileclinic through hypertext links (“linked sites”), and is not responsible for their content. The linked sites are for your convenience only and you access them at your own risk. In no event will emobileclinic be liable to any party or any general, special, direct, indirect, incidental, consequential, exemplary and punitive damages for any use of any linked site.
Complaints
Any complaint about emobileclinic or medical advice or diagnosis provided by emobileclinic doctors will be handled in writing or e-mail to emobileclinic If the matter is not solved then a telephone or Skype call will be needed to resolve the problem. Emobileclinic will not be responsible for any fees or lost time if they are incurred. These terms and conditions shall be governed by and construed in accordance with the laws of Nigeria . Disputes arising shall be exclusively subject to the jurisdiction of the courts of Law.
Complaints Procedure
If you have a complaint about the services from emobileclinic please contact us by phone or e-mail stating your email and password, the date the problem occurred and which emobileclinic member of staff was involved. emobileclinic takes any complaints about our medical services very seriously, so we may call you to fully discuss the problem.
Copyright
Emobileclinic contains copyrighted material, trademarks and other proprietary information of (collectively “Proprietary Material”), including, but not limited to, text, software, photos, graphics and images. You agree not to modify, publish, transmit, participate in the transfer or sale, create derivative works of, or in any way exploit, in whole or in part, any Proprietary Material. Except as otherwise expressly permitted under copyright law, no posting, copying, downloading, uploading, transmission, retransmission, distribution, redistribution, publication, republication, recompilation, disassembling, reverse engineering, or otherwise modifying or commercially exploiting of any Proprietary Material or material made available through emobileclinic will be permitted without the express permission of the
copyright owner. In the event of any copying, redistribution or publication of copyrighted material as permitted by law, no changes in or deletion of author attribution, trademark, legend, or copyright notice shall be made. The obligation of determining that any material is not subject to intellectual property right(s) rests on you.
